Terms of Service

Welcome to Clutch Picks. By creating an account or using the Clutch Picks mobile application ("App"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Eligibility

You must be at least 18 years of age and a legal resident of the United States to use Clutch Picks. By registering, you represent and warrant that you meet these requirements. Clutch Picks is void where prohibited by law. It is your responsibility to determine whether participation is legal in your jurisdiction.

2. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You may not create more than one account. Clutch Picks reserves the right to suspend or terminate accounts that violate these Terms.

3. How the Game Works

Clutch Picks is a free-to-play sports prediction game. You may have one active pick at a time — select an upcoming sports matchup and predict the winner. Correct picks extend your streak; an incorrect pick resets it to zero.

Clutch Picks is a game of skill. Winners are determined by their prediction record, not by chance.

Monthly Winner Determination:

• A minimum winning streak of 5 consecutive correct picks is required to qualify for the monthly prize.
• The player with the longest active winning streak at the end of each calendar month wins.
• In the event of a tie in streak length, the tiebreaker is applied in the following order: (1) most total wins that month, (2) highest win percentage that month (minimum 10 picks required for win percentage to apply).
• A pick must be placed before the scheduled game start time to count. Picks cannot be placed or changed once a game has begun.
• Picks on postponed or cancelled games are voided and do not affect streak or win totals.
• Players may forfeit an active pick at any time before the game concludes. A forfeited pick counts as a loss and resets the player's streak.
• Clutch Picks reserves the right to void picks or disqualify players in cases of data errors, system issues, or violations of these Terms.

4. Monthly Prize Contest

Each calendar month, Clutch Picks awards one or more prizes to the top-performing player(s). This is a skill-based contest — winners are determined solely by their prediction record, not by chance or random selection. Prizes may include cash, gift cards, subscription credits, digital badges, or other items as announced each month. Prize details are displayed in the app's Prizes tab prior to the start of each month.

No Purchase Necessary. A subscription is not required to participate or win. Free users may participate and win on equal footing with subscribers. For users who prefer not to use the app, a free alternative entry method is available at clutchpicks.vercel.app/enter. Free entry participants are entered into end-of-month prize consideration but do not accumulate a streak or appear on the leaderboard.

Cash prizes will be paid via PayPal or another mutually agreed method within 30 days of the end of the qualifying month. Winners may be required to provide identification and a completed IRS Form W-9 before receiving prizes. Prizes with a combined value of $600 or more in a calendar year may be reported to the IRS on Form 1099-MISC.

Clutch Picks reserves the right to modify, substitute, or cancel prizes at any time, and to disqualify any player found to be violating these Terms.

5. Prohibited Conduct

You agree not to:

• Create multiple accounts or use bots, scripts, or automated tools
• Attempt to manipulate game outcomes or the leaderboard
• Harass, abuse, or threaten other users
• Use the App for any unlawful purpose
• Reverse engineer or attempt to extract source code from the App

6. Subscriptions

Clutch Picks offers an optional premium subscription ("Clutch Premium") at $1.49/month. Subscribers receive an ad-free experience and a Clutch Premium badge on the leaderboard. Subscriptions do not confer any advantage in pick outcomes or prize eligibility beyond what is available to free users.

Subscriptions are billed monthly. You may cancel at any time. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial months.

7. Intellectual Property

All content in the App, including but not limited to the name "Clutch Picks," logos, graphics, and software, is owned by or licensed to Clutch Picks and may not be copied, reproduced, or distributed without prior written consent.

8. Disclaimers & Limitation of Liability

The App is provided "as is" without warranties of any kind. Clutch Picks does not guarantee uninterrupted service, accuracy of sports data, or availability of prizes. To the maximum extent permitted by law, Clutch Picks shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Changes to These Terms

Clutch Picks may update these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. We will notify users of material changes via the App or email.

10. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the applicable courts of the United States.
